You do not have permission to reproduce, redistribute, sell, create derivative works from, decompile, reverse engineer, or disassemble AllIndies.com nor any content that appears on AllIndies.com. You agree not to take any measures to interfere with or damage AllIndies.com or the use of AllIndies.com. All rights not expressly granted by Dilating Productions, LLC are reserved.

Copyright infringement is the occurrence of reproduced, distributed, performed, publicly displayed, or a derivative of work without the permission of the copyright owner.
Dilating Productions, AllIndies.com, and affiliates are not responsible for ensuring content is not infringing upon the copyright of other material. It is the responsibility of the person submitting the content to obtain permission and/or licenses to use protected content.
Giving permission to post copyright-infringing content can lead to the immediate removal of your content and possibly monetary damages. Dilating Productions LLC, AllIndies.com and its affiliates respect the creativity and rights of all artists so please help us to keep the Allindes.com community positive and legal.

Video Submission
Please submit only videos that you have rights to publish or give permission to publish.
To submit a video, send an email to production@DilatingProductions.com. Please include the following:
• Your name, title and contact information
• Name of the video
•Director’s name

At the time that you submit a video, you grant Dilating productions LLC, AllIndies.com and its’ affiliates a limited, worldwide, non-exclusive, royalty-free license and right to copy, transmit, distribute, publicly perform and display (through all media now known or hereafter created), and make derivative works from your video.
You grant visitors of AllIndies.com and any affiliated media to watch your video for non-commercial purposes.
This license agreement shall continue indefinitely or until you send a written request for removal and said content is removed from AllIndies.com and any affiliated media. Dilating Productions, LLC or AllIndies.com shall remove content within a reasonable period of time after a written request is received. The license for legal archival/preservation purposes will always continue indefinitely. Your video may be in search engine indices after removal which Dilating Productions, LLC, AllIndies.com nor its’ affiliates has control over such caching.
Commercial Videos
Videos that are used for commercial purposes will be charged a fee. Content that is used to promote a business, product, event, or etc are considered as being used for commercial purposes and therefore, must go through the advertising department.
Your Privacy
We respect the privacy of everyone who is supporting the AllIndies.com community by visiting the site, whether watching videos or not. We do not share your information with anyone.
Liability
To the fullest extent permitted by law: (i) AllIndies.com, Dilating Productions, LCC and its’ affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data or other intangible losses.
Your Representations and Warranties
You represent and warrant that: (i) you have the right to submit the content to AllIndies.com and grant the licenses set forth above; (ii) AllIndies.com, Dilating Productions LLC nor its’ affiliated will not need to obtain licenses or pay royalties to any third party; (iii) the content does not infringe on any third party's rights, including intellectual property rights and privacy rights; and (iv) the content complies with this entire Agreement and all applicable laws.
Indemnification
You will indemnify, defend, and hold harmless AllIndies.com, Dilating Producitons and its’ affiliates, directors, officers, employees, and agents, from and against all third party actions that: (i) arise from the submission or distribution of your video; (ii) assert a violation by you of any term of this Agreement; or (iii) assert that any content you submitted to AllIndies.com violates any law or infringes any third party right, including any intellectual property or privacy right.
Compliance Notice Pursuant to 18 U.S.C. § 2257
All pictures, graphics, videos, and other visual media displayed on AllIndies.com are exempt from 18 U.S.C. § 2257 and 28 C.F.R. 75 because they do not contain depictions of conduct as specifically listed in 18 U.S.C. § 2256 (2) (A) - (D), but are at most, depictions of non-sexually explicit nudity, or are depictions of simulated sexual conduct. Dilating Productions LLC, AllIndies.com, and its’ affiliates are not the primary producer(s) of the visual content contained in AllIndies.com.
Governing Law
This Agreement shall be governed by the laws of the State of Michigan, United States of America, without regard to principles of conflicts of law. The Uniform Commercial Code, the Uniform Computer Information Transaction Act, and the United Nations Convention of Controls for International Sale of Goods shall not apply.
Disputes
Any action arising out of or relating to this Agreement or your use of AllIndies.com must be commenced in the state or federal courts located in Wayne County, Michigan, United States of America (and you consent to the jurisdiction of those courts). In any such action, AllIndies and Dilating Productions and you irrevocably waive any right to a trial by jury.
Interpretation; Severability; Remedies
Headings are for convenience only and shall not be used to construe the terms of this Agreement. If any term of this Agreement is found invalid or unenforceable by any court of competent jurisdiction, that term will be severed from this Agreement but will not sever the entire agreement. No failure or delay by AllIndies or Dilating Productions in exercising any right hereunder will waive any further exercise of that right. AllIndies and Dilating Productions rights and remedies hereunder are cumulative and not exclusive.
Successors; Assignment; No Third Party Beneficiaries
This Agreement is binding upon and shall inure to the benefit of both parties and their respective successors, heirs, executors, administrators, personal representatives, and permitted assigns. You may not assign this Agreement without prior written consent from AllIndies.com or Dilating Productions, LLC. No third party shall have any rights hereunder.
Notices
You consent to receive all communications including notices, agreements, disclosures, or other information from AllIndies.com and Dilating Productions, LLC electronically. Notices may be posted on Allindies.com or emailed directly to you.

Nothing herein shall limit AllIndies, Dilating Productions, LLC nor its’ affiliates right to object to subpoenas, claims, or other demands.
Modification
This Agreement may not be modified except by a revised Terms of Service posted by AllIndies.com on AllIndies.com or a written amendment signed by an authorized representative of AllIndies.com. A revised Terms of Service will be effective as of the date it is posted on AllIndies.com.
Entire Agreement
This Agreement constitutes the entire understanding between you and AllIndies.com and Dilating Productions LLC. This agreement supersedes any and all prior agreements and understandings regarding the same.
